RETURN DEADLINE
In Texas, landlords must return your security deposit within 30 days of you vacating the property.
This deadline typically starts from the day you return the keys and the property is empty. The landlord must either return the full deposit or provide an itemized statement explaining any deductions.
PENALTIES FOR LATE RETURN
Up to 3x your deposit in damages!
If your landlord wrongfully withholds your deposit, you may be entitled to 3 times the amount withheld as damages.
Bad faith retention: $100 + 3x deposit wrongfully withheld + attorney fees.
MAXIMUM DEPOSIT LIMIT
No statutory limit
If your landlord collected more than the legal maximum, you may have additional claims.
